The 5th amendment of the constitution grants US citizens the right against self incrimination.

The Law/Courts can't make you speak against your will.
If you ask for a lawyer, they cant even question you.
If you do answer a question after you ask for a lawyer, what you say can't be used in court.

The problem is that these kids aren't American citizens.

or at least, they cant prove they are.

I fail to see how the 5th amendment would keep you from getting arrested at the border as they seemed to think. As far as I understand it you can very well be arrested but you are to be given a lawyer and you don't have to talk about anything. But why would they think they could just mention the amendment and be on their way?

You are correct, they obviously were going by a tumblr book of law.

I wouldn't even be surprised if such a thing existed...

Wait. So can I say, "I plead the 5th. Also, I killed that dude." I'm pretty sure the 5th is just that you don't have to talk, not that what you say cannot be used against you in court. Basically Miranda Rights.
User avatar #9 to #8 - MuahahaOfLore (10/29/2015) [-]
You dont need to plead it, you just need to keep your mouth shut.

If you are questioned and you do plead it they can still question you.

If you invoke your right to an attorney and they question you and you talk without an attorney, that evidence produced is inadmissible in court
User avatar #10 to #9 - cubicalpayload (10/29/2015) [-]
Ah. But it would still be better to not talk, right?
User avatar #11 to #10 - MuahahaOfLore (10/29/2015) [-]
If you are ever being questioned, and you have any slight possibility you might have something to hide. . .

ALWAYS keep your mouth shut.
your lawyer will thank you.

cubicalpayload said it, but I'll say it again because it's SUPER important. ALWAYS keep your mouth shut. ALWAYS. The most corrupt officer will lie and say "the only way for you to help yourself is to tell me x, or y." They're full of **** . They're trying to feel out your answers to catch you in a lie. It's legal for them to lie to you, but not vise versa. The best way to help yourself is to put your hands behind your back and move when they tell you to, but don't say **** until your lawyer shows up

> Not in the country
> Not American citizens
> Not being arrested for a crime
> Nothing they said was used to self-incriminate them in a court of law

Say what about the 5th amendment now?
#7 to #2 - justtocomment (10/29/2015) [-]
"Failure to identify to law enforcement" isn't covered by the 5th amendment. That's why you can't just plead the fifth during a traffic stop.
User avatar #19 to #7 - amalone (10/29/2015) [-]
But you can. They don't want you to believe that you can, and they've succeeded, sadly, but you can, in fact, plead the 5th at a traffic stop. It would make your life easier, if you went ahead and showed him your ID, don't get me wrong, but this isn't Nazi Germany where you have to "Halt, and present your papers."
#21 to #19 - justtocomment (10/29/2015) [-]
5th amendment only applies to court proceedings and interrogations. Not interviews or traffic stops. Your right to withhold identification was suspended the moment the officer found reasonable suspicion (not probable cause) that you were committing, or had committed, a crime. This same liberty extends to traffic checkpoints, as the "reasonable suspicion" extends to anyone driving through that area at that time. The same goes for when you're simply walking down the street: if an officer finds reasonable suspicion that you might have committed a crime, are in the process of committing one, or will commit one, then they can stop you and require identification or receive it themself via a Terry frisk.
Note the recurring key term here: reasonable suspicion. In Terry v. Ohio (1968) the supreme court upheld a decision that would serve to give law enforcement officers EXTREME leeway in regards to their right to search, and require identification from, individuals. Essentially, the law used to require "probable cause" which meant a viable and provable reason to perform further searches and inquiries. Terry v. Ohio introduced "reasonable suspicion" which only requires that an officer, according to their training, is led to believe you may have done something, or will do something, illegal.
Nazi Germany? Hardly. But try pleading the fifth at your next traffic stop and time how long before you're pulled out of the car.

"A cop can question and harass you if you look funny, or look like you'll do something funny, and you as a citizen who obeys the state, should not dissent, or they'll throw you out of the car." Sounds pretty Nazi to me. I give you this.
