It's not rape if it's consensual, and it sure as hell doesn't matter if he lied. I think it falls under rape and quite rightly so in my opinion. At the very least it's like a "sexual fraud" or something. I think the effect on a person is quite similar to what a rape victim would feel. Humiliation, vulnerability. The only difference is that perhaps you don't get the physical enforcement element of your typical "alleyway balaclava rape". But then you might do, who knows?

Deception talks about a much further betrayal of trust to gain money or property, so if you've truly "deceived" someone to the letter of the law to gain sex, you're guilty of rape by deception.
